CREATING THE INFANTA CONSUMER WELFARE AND PROTECTION
COUNCIL AND FOR OTHER
PURPOSES.”

BE IT ENACTED
Sangguniang Bayan of Infanta in session assembled, that:
CHAPTER 1. TITLE AND DECLARATION
SECTION 1. TITLE. This Ordinance shall be known as the 2013
Consumer Welfare and
Protection Council Ordinance.
SECTION 2. DECLARATION OF POLICY. The local government is
duty bound not only to
promote the welfare of the business sector but likewise to
protect the welfare and interest
of the consuming public through strict enforcement of laws;
price monitoring inter-agency
collaboration and other appropriate measures.
CHAPTER 2. THE COUNCIL
SECTION 3. There is hereby created a Consumer Welfare and
Protection Council which is
vested with the policy and decision-making authority in
accordance with existing laws.
SECTION 4. COMPOSITION. The Council shall be composed of the
following:
Chairperson : Mayor/ Local Chief Executive
Vice-Chairperson : SB Chairperson, Committee on Trade and
Industry
Members:
1. Municipal Treasurer
2. Local Chief of Police
3. Municipal Health Officer
4. Representative, National Food Authority
5. President, Infanta Legion Chamber of Commerce
6. President, Infanta Meat Vendors Association
7. 2 Representatives, Consumers and Commuters Association
8. Municipal Agriculturist
9. 2 Representatives, Non-governmental Organization
10. 2 Representatives, Farmers and Fisherfolk Association
11. President, Federation of Infanta Tricycles Association
(FITA)
12. District Supervisor
13. President, PPLB
14. President, PPSK
15. Department Head, MENRO
16. Officer, Information Office
SECTION 5. DUTIES AND RESPONSIBILITIES. It shall be the duty
and responsibility of the
Consumer Welfare and Protection Council to: 1. Plan and
implement programs and activities that will protect the welfare and interest of
the consumers;
2. Plan and implement activities in support to the
observance of National Consumer
Welfare and Protection Month every October;
3. Coordinate the enforcement of Price Tag Law and other
Fair Trade Laws;
4. Coordinate the monitoring of process of basic goods and
services and prime
commodities in the Municipality;
5. Coordinate product distribution and price monitoring
programs, project and measures of
the government;
6. Develop comprehensive strategies to ensure that prices of
basic goods and prime
commodities are maintained at affordable levels. And
7. Coordinate the prevention and/or prosecute any and all
persons engaged in price
manipulation and violation of authorized price ceilings and
Price Tag Law; hoarding or any
combination thereof, and perform such other functions as may
be prescribed by law or
ordinance.
SECTION 6. MEETING. The Council shall meet and convene every
last Friday of the quarter.
A special meeting may be called by the Chairperson on his
initiative or upon the request of
any members of the Council should the need arises.
CHAPTER 3. EXECUTIVE COMMITTEE
SECTION 7. An Executive Committee is hereby created that
will attend to matters which
need immediate action by the body without having to convene
all members of the
Consumer Welfare and Protection Council to be composed of
the following or their
permanent representatives:
Chairperson : Municipal Mayor/ Local Chief Executive
Vice Chairperson : SB Chairperson, Committee on Trade and
Industry
Members :
1. Municipal Treasurer
2. Local Chief of Police
3. Municipal Agriculturist
4. District Supervisor
5. President, Infanta Legion Chamber of Commerce
6. Consumers and Commuters Representatives
SECTION 8. SECRETARIAT. The Information Office shall compose
the Secretariat.
CHAPTER 4. APPROPRIATIONS
SECTION 9. To defray the operational expenses necessary for
the effective implementation
of this ordinance, funds shall be sourced out from the
annual budget of the municipal
government annually in the sum of fifty thousand pesos
(50,000).
CHAPTER 5. FINAL PROVISIONS
SECTION 10. SEPARABILITY CLAUSE. In the event that one or
more of the provisions of
this ordinance are held illegal or unconstitutional, the
validity of the other provisions shall
not be affected thereby and shall continue to be in full
force and effect.
SECTION 11. REPEALING CLAUSE. Any ordinance, resolution or
order, either part or parts
hereof, which are inconsistent with the provisions of this
Ordinance are hereby amended,
repealed or modified accordingly.
SECTION 12. EFFECTIVITY CLAUSE. This Ordinance shall take
effect immediately upon its
approval
